1. Sellers
Selling on CBMix involves strict adherence to our internal policies and all applicable laws, especially when selling overseas. All sellers must comply with the following:
1.1. Trade Agreements and Compliance Programs
CBMix is committed to ensuring that all cross-border transactions comply with relevant international trade agreements and customs programs. Sellers must adhere to the specific requirements of each destination country to benefit from reduced tariffs and streamlined customs procedures.
Brazil: Remessa Conforme Program
- Participating Sellers: All sales to Brazil must adhere to the Remessa Conforme Program of the Receita Federal do Brasil. This includes full compliance with tax and customs regulations.
- Documentation and Reporting: Sellers are required to maintain accurate records of transactions, product origins, and other relevant data to ensure transparency and ease of audit.
Canada and Mexico: United States-Mexico-Canada Agreement (USMCA)
- Participating Sellers: Sellers exporting to Canada or Mexico must ensure that their products meet the Rules of Origin as defined by the USMCA to qualify for preferential tariff treatment.
- Documentation and Reporting: A valid Certificate of Origin must accompany shipments. Sellers should retain all supporting documents to substantiate the origin of goods.
Chile: U.S.-Chile Free Trade Agreement
- Participating Sellers: Sellers exporting to Chile can benefit from reduced tariffs if their products qualify under the U.S.-Chile Free Trade Agreement.
- Documentation and Reporting: Proper certification and records demonstrating compliance with the agreement’s provisions are required.
Colombia: U.S.-Colombia Trade Promotion Agreement
- Participating Sellers: Eligible products exported to Colombia may receive preferential treatment under this agreement.
- Documentation and Reporting: Sellers must ensure that all necessary documentation is in place to validate the eligibility of goods under the agreement.
Israel: U.S.-Israel Free Trade Agreement
- Participating Sellers: Exports to Israel may be eligible for reduced or eliminated duties under the U.S.-Israel Free Trade Agreement, provided they meet the agreement’s criteria.
- Documentation and Reporting: Sellers must provide appropriate documentation verifying the origin and compliance of goods with the terms of the agreement.
1.2. Seller Admission and Monitoring
Based on our internal policies the following measures apply:
- Verification of Identity and Legality: Sellers must provide valid documentation proving identity and the legal operation of their business.
- Compliance Checks: Prior to admission, a thorough evaluation ensures that sellers’ activities comply with both their home country’s regulations and those applicable at the destination country.
- Product Verification: All products must meet the destination country import norms, ensuring they are not at risk of being classified as forbid, contraband or counterfeit.
- Ongoing Monitoring: Sellers are subject to periodic audits and product monitoring to verify continued compliance. Any deviation from our standards may result in suspension or termination of the seller’s account, and CBMix reserves the right to notify appropriate authorities if necessary.
1.3. Commitment to Conformity
CBMix, through its proprietor, reaffirms a commitment to:
- Strict Adherence to Tax and Customs Laws: Ensuring that all transactions comply with US and destination countries legal requirements, including proper tax calculation and remittance.
- Prevention of Illicit Trade: Actively combating practices such as undervaluation, smuggling, and the circulation of counterfeit goods.
- Cooperation with Authorities: Providing necessary records and cooperating fully with tax and customs authorities for audits or investigations.
2. Shippers – Discounted Shipping Labels
CBMix provides discounted shipping labels to approved Shippers for use exclusively in their own logistics and fulfillment operations. These labels are not intended for resale but rather to support efficient, cost-effective shipping for various business models.
2.1. Process and Delivery
- Shipping label requests are made directly to CBMix via approved channels such as WhatsApp.
- Shippers must provide accurate shipment details including destination, weight, dimensions, and packaging type.
- CBMix will quote a shipping label price based on the provided information.
- Labels are generated and delivered only after payment is confirmed.
- Labels are delivered digitally (e.g., via WhatsApp or email), and are considered fulfilled once sent.
2.2. Responsibility and Carrier Adjustments
- All shipment information must be declared truthfully by the Shipper.
- CBMix is not liable for additional charges applied by the carrier (e.g., FedEx, USPS, UPS) due to discrepancies in weight, dimensions, packaging, or prohibited contents.
- Any carrier adjustments will be billed to the Shipper. CBMix reserves the right to automatically deduct fees from the Shipper’s balance or issue a separate invoice.
2.3. Refund and Dispute Policy
- Shipping labels are classified as digital services and are non-refundable once issued.
- In the event of a payment dispute or chargeback, the Shipper must provide proof of shipment use and client authorization upon request.
- Failure to resolve chargebacks may result in restricted access to CBMix services
2.4. Usage and Compliance
- Shipping labels provided by CBMix may only be used for the operations of the requesting Shipper or Logistic Operator.
- Unauthorized resale, redistribution, or third-party transfer of shipping labels is strictly prohibited.
- Violations of this policy may result in suspension or termination of service and may trigger legal liability.
3. Logistic Operators
Logistic partners on the CBMix platform must:
- Adhere to Delivery Standards: Guarantee prompt, secure, and efficient handling of all shipments, in compliance with applicable shipping and safety regulations.
- Maintain Accurate Tracking: Provide real-time tracking and reliable status updates to both CBMix and the end customer.
- Compliance with Customs Regulations: For international shipments, ensure all necessary documentation and processes are in place to meet the section 1.1. Trade Agreements and Compliance Programs requirements.
4. Affiliates
Affiliates partnering with CBMix agree to:
- Honest Representation: Promote CBMix’s products and services in an accurate and ethical manner, without misrepresentation.
- Adherence to Marketing Guidelines: Follow all brand guidelines and ensure that promotional materials are approved by CBMix prior to publication.
- Transparency and Reporting: Provide regular performance reports and cooperate with CBMix in tracking affiliate-driven sales, ensuring full transparency.
Final Provisions
- Amendments: CBMix reserves the right to modify these Terms and Conditions at any time. Changes will be communicated through our website and will take effect upon posting.
- Severability: If any provision is held invalid or unenforceable, the remaining terms will continue to be valid and enforceable.
